Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Feedika(the "Service"), operated by QikBuild, s. r. o., a company registered in Slovakia with its registered office at Bottova 2A, 811 09 Bratislava – mestská časť Staré Mesto, Slovakia ("QikBuild", "we", "us", or "our"). This document is provided as a general-purpose template and should be reviewed by qualified legal counsel before it is relied upon as your organization's binding terms of service.

1. Acceptance of terms

By creating an account, installing the Feedika widget, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

2. Description of the service

Feedikais a visual bug reporting and feedback SaaS platform. It provides a lightweight widget that can be embedded on a customer's website, allowing visitors to capture screenshots, annotate issues, and submit reports that are collected in a team inbox for triage and management.

3. Accounts and registration

  • You must provide accurate, current, and complete information when creating an account and keep it up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us promptly at [email protected] if you become aware of any unauthorized use of your account.

4. Subscriptions, fees, and billing

  • Certain features of the Service require a paid subscription. Applicable fees, billing cycles, and plan details are presented at the time of purchase or in an order form.
  • Unless stated otherwise, subscription fees are billed in advance on a recurring basis and are non-refundable except as required by applicable law.
  • We may change our pricing with reasonable advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
  • Failure to pay applicable fees may result in suspension or termination of your access to the Service.

5. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation;
  • Infringe the intellectual property, privacy, or other rights of any third party;
  • Upload or transmit malicious code, or attempt to gain unauthorized access to the Service or related systems;
  • Interfere with or disrupt the integrity or performance of the Service; or
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by law.

6. Customer data and intellectual property

  • Your data:You retain all rights to the feedback, screenshots, and other content submitted through the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service.
  • Our IP: The Service, including its software, design, and branding, is owned by QikBuild, s. r. o. and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features beyond what is necessary to use the Service.

7. Third-party services and integrations

The Service may integrate with or link to third-party services (for example, project management or communication tools). We are not responsible for the availability, content, or practices of third-party services, and your use of them is subject to their own terms and privacy policies.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

9. Limitation of liability

To the maximum extent permitted by applicable law, QikBuild, s. r. o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law.

10. Termination

  • You may stop using the Service and cancel your subscription at any time in accordance with the cancellation process made available in the dashboard.
  • We may suspend or terminate your access to the Service if you breach these Terms, fail to pay applicable fees, or if we discontinue the Service, with notice where reasonably practicable.
  • Upon termination, your right to use the Service will cease, and we may delete your account data after a reasonable retention period, subject to our Privacy Policy and legal obligations.

11. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of the Slovak Republic, unless mandatory consumer protection law provides otherwise.

12. Changes to these terms

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date above. Material changes will be communicated to registered users where appropriate, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
